Orissa High Court refuses pre-arrest bail to news editor booked over video remarks about minister

Capital Police in Bhubaneswar booked the editor-in-chief of a digital news platform after a video of his remarks about a State minister was widely circulated on social media. The editor sought pre-arrest bail, saying custodial interrogation was not needed. The Orissa High Court rejected the plea on 6 August 2026 and left the prosecution pending.

How we verify →

Pre-arrest bail stands rejected and the criminal case before the SDJM, Bhubaneswar remains pending investigation.

What happened

The High Court recorded that the case arose from remarks made during an Odisha Swabhiman Mancha programme on 12.07.2026, where the editor claimed a State minister had tried to bribe him to suppress reports about textbook errors, and that a video of the claim was uploaded and widely circulated on Facebook and other social media platforms.

Police said the complaint described the statements as false, fabricated, malicious and defamatory, published to tarnish the minister's reputation, mislead the public and disturb public order and confidence in the government, and registered Capital PS case no. 561 dated 14.07.2026 under Sections 353, 196 and 356 BNS.

The editor told the High Court that even taking the allegations at face value, custodial interrogation was not warranted, that his listed criminal antecedents were irrelevant, and that co-accused persons taken into custody had been released on bail.

The State opposed bail by citing materials on record including the Section 183 BNSS statement of a correspondent working under the editor, and by placing a list of 20 prior criminal cases across police stations between 2022 and 2026 before the Court.

Justice V. Narasingh held that the materials did not warrant the exceptional remedy of pre-arrest bail, rejected the application, and clarified that the observations were only for the bail plea and that the accusation had to be established independently in the ongoing probe.

What the record says

“Considering the materials on record and perusal of the statement of the correspondent, who works under the Petitioner, recorded under Section 183 of BNSS and other statements, this Court is not inclined to entertain the application of the Petitioner for grant of “exceptional remedy” of pre-arrest bail. The same accordingly stands rejected.”
