How we verify →

Seizure and show-cause proceedings were quashed and Customs was directed to release the consignment and issue waiver certificates.

What happened

The High Court recorded that the importer brought 28 MT of roasted areca nuts from Indonesia and filed Bill of Entry No. 5470956 dated 06.09.2024 valued at Rs 35,65,800 under tariff entry 20081920.

The High Court recorded that Customs first sent samples to CRCL New Delhi, which reported the goods as roasted areca nuts, then sent samples to ICAR-CPCRI Kerala, which said roasting could not be ascertained, and then issued a seizure memo on 06.12.2024 under Section 110 alleging Foreign Trade Policy violation.

The High Court recorded that Customs later issued a show-cause notice dated 17.12.2024 rejecting classification under entry 20081920, re-determining demand of about Rs 1.62 crore to Rs 1.78 crore, and alleging the goods were prohibited and liable to confiscation.

The High Court held the provisional assessment, re-classification under Chapter 8, valuation and show-cause proceedings were premature and contrary to Sections 17, 18 and 28 and the Valuation Rules, and allowed the petitions.

The High Court ordered quashing of the seizure memorandum, impugned communications and show-cause notice, release of the goods as declared, and issuance of waiver certificates for demurrage, detention and ground rent within 15 days from the judgment.
