How we verify →

The duty, interest and penalties against the forwarder stand quashed by the Madras High Court order dated 19 August 2026.

What happened

The High Court recorded that the dispute arose from Bill of Entry No.4228874 dated 01.12.2017 filed in the name of a Nellore firm, declared as gas stoves and spare parts, which the DRI Chennai examined and found to conceal undeclared needles and tapes.

The Customs Department alleged that the forwarder received documents from an untraceable person, gave them to the Customs Broker, paid duty from his firm's bank account, took the delivery order and arranged examination and clearance, and treated him as beneficiary and importer.

The Court held that involvement in clearance alone did not prove ownership or knowledge of concealment, that agency under Section 147(3) was not established, and that penalties under Sections 114A and 114AA needed proof of liability and knowing use of false documents.

The Court set aside Order-in-Original No.105387/2024 dated 19.03.2024 insofar as it fastened differential duty, interest and penalties on the forwarder, leaving other noticees unaffected.
