What happened
The High Court recorded that on 25.06.2021 at about 18.00 hours a revenue official and assistants proceeded to the scene of occurrence, conducted a search, seized the materials and drew samples.
The High Court recorded that the materials were later recovered from the Village Administrative Officer, samples were drawn at 22.30 that night and sent to the lab on 06.07.2021, with the lab report dated 18.04.2023.
The High Court recorded that testing norms IS 2796 and IS 1460 for motor spirit and high speed diesel respectively were discussed, with no allegation of PDS diversion, adulteration, cheating or subsidy theft stated in the excerpt.
The High Court held that the initial search by an unauthorised team was flawed and later takeover would not, by itself, cure the defect in the initial search and seizure, and that delay and non-communication harmed sample reliability and re-test opportunity.
The High Court ordered that this Criminal Original Petition is allowed and C.C.No.314 of 2023 pending on the file of the learned Judicial Magistrate No.II, Namakkal, is hereby quashed.
