What happened
The Court recorded that police alleged that on an afternoon in May 2010 at an eatery in Krishna Nagar, Delhi, three pairs of adults were found in intimate contact at separate tables. Police also alleged that three erotic publications were kept on tables and at the counter to attract customers.
The Court stated the charge was under the provision punishing one who does any obscene act in a public place to the annoyance of others. The judgment set out the text of Section 294 and its punishment of up to three months with or without fine.
The Court found contradictions in police testimony, no independent witnesses, and unsealed case property. The Court gave the remaining accused the benefit of doubt.
The Court acquitted the remaining accused of the Section 294 charge. The Court noted that other co-accused had earlier admitted guilt and were convicted in August 2010 and August 2011.
