High Court frees man detained without trial as a 'bootlegger' under Gujarat's anti-social activities law

Surat's District Magistrate ordered a man preventively detained as a 'bootlegger' under the Gujarat Prevention of Anti-social Activities Act on 3 August 2026, citing Prohibition Act cases at Olpad police station. The Gujarat High Court quashed the detention on 23 September 2026 and ordered his release. It held the grounds did not show any threat to public order.

How we verify →

Released by order of 23 September 2026 unless wanted in another case; the Prohibition Act cases continue.

What happened

The High Court recorded that the detention order dated 03.08.2026 branded the man a bootlegger under Section 2(b) of the Act, relying on Prohibition Act cases registered at Olpad police station.

The petitioner argued the grounds concerned at most law and order, not public order, as registering liquor offences does not by itself affect public order.

The High Court held the detaining authority's satisfaction was not legal or valid and quashed the order, directing his release unless required in another case.

What the record says
