High Court quashes liquor-transport prosecution against a Rohru driver

How we verify →

The FIR and all consequential proceedings stand quashed against the driver.

What happened

The High Court recorded that police stopped a vehicle on Jakhar Road near Rohru on 12 December 2022 and found 84 bottles of IMFL, 24 bottles of country liquor and 180 bottles of beer.

The High Court recorded that police seized the liquor, arrested the driver, sent samples to the forensic laboratory and filed a charge sheet.

The High Court said the Assistant State Taxes and Excise Officer, Rohru Circle, verified the owner's transport permit. The State's status report acknowledged that the quantity carried was less than the quantity authorised.

The High Court held that no offence under Section 39(1)(a) had been committed and that continuing the proceedings would be futile. It quashed the FIR and consequential proceedings against the driver.

What the record says

“In the present case, admittedly, the liquor being transported was less than what was mentioned in the permit. Therefore, no offence punishable under Section 39 (1) (a) of the of Punjab Excise Act has been committed in the present case.”
