How we verify →The FIR, charge-sheet and proceedings under the Gambling Act continue after refusal to quash.
What happened
The High Court recorded that the crime was registered on a report by a police official who said secret information about gambling led police with panchas to the spot where nine persons were intercepted.
The High Court recorded that a spot panchnama was drawn, playing cards and amounts were recovered, and the investigating officer filed a charge-sheet after investigation.
The High Court recorded that the FIR recitals showed the persons were found gaming with cards and cash at a street where the public have access, making prima facie material for Section 12(a).
The High Court held that the quashing tests were not met and rejected the application, so the gambling prosecution continues.
What the record says
“The recitals of the First Information Report at this stage sufficiently show that the applicants were not only found gaming but the relevant material, i.e. playing cards as well as some amounts were also seized from them and they were found playing cards at the street, where the public is having access.”
