What this record means

This page records what the cited court records say happened. Findings belong to the court or authority that made them; this register adds none of its own. Names of private individuals are withheld unless a naming gate clears them.

How we verify →

The FIR stands quashed; any further action must follow non-cognizable procedure.

What happened

The High Court recorded that the applicant sought quashing of C.R. No. 478 of 2025 registered with Dongri Police Station for alleged offences under COTPA Sections 7(3) and 20(2) and BNS Section 223.

The High Court recorded that the applicant's counsel submitted none of the sections were cognizable so police could not have registered an FIR.

The High Court recorded that the Additional Public Prosecutor did not dispute that the sections are non-cognizable and admitted an FIR could not have been registered.

The High Court quashed the FIR but said police may take appropriate steps for the non-cognizable offences in accordance with law.

No complaining victim

The prosecution was for selling or importing tobacco without prescribed warnings and labels, an act with no complaining victim.

What we could not confirm

The order does not describe the underlying shop, goods, or conduct; no counterfeit or smuggling allegation appears in it. FIR date and incident date could not be confirmed beyond C.R. year 2025.
