CW-1955-0001Satara, MaharashtraJudgment 2 December 1955

The State v. Satara Police Police Patil

The judgment of the Bombay High Court records the following account. Police Patil Shamrao Patil demanded and received Rs.25 for issuing a solvency certificate for use in criminal proceedings. The Special Judge, North Satara, accepted the payment was proved but acquitted on the ground that issuing the certificate was no part of a Police Patil's duty and hence no official act. The High Court held an official act under IPC s.161 need only be done in official capacity, not be an obligatory duty, and issuing the certificate as Patil qualified. It allowed the State appeal, convicted the accused under s.161 IPC, and sentenced him to six months' rigorous imprisonment with an arrest warrant.
