Conviction
ConcludedThe trial court convicted the accused police personnel, as recorded in the Orissa High Court judgment.
The judgment of the Orissa High Court records the following account. An Assistant Sub-Inspector and a Constable visited Harikucha village in connection with a theft case, took a fowl and biri without payment, and the next morning accepted a goat and plantains as gratification for forbearing to act officially. The Special Judge, Sambalpur convicted the ASI under section 161 IPC (2 years RI) and the Constable on two counts under section 165 IPC (1.5 years RI each, concurrent). On 26 November 1956 the Division Bench dismissed their appeal, holding the Superintendent of Police had validly sanctioned prosecution after supervising the investigation and that all charges formed one transaction. The court confirmed both convictions and sentences on the eyewitness evidence. Matters not addressed in the cited judgment text are not recorded here.
