CW-1958-0002Guna, Madhya PradeshJudgment 18 August 1958

Madhya Bharat Police Sub-Inspector v. State of Madhya Bharat

The Madhya Bharat High Court (now Madhya Pradesh High Court) dismissed the Article 226 petition of Sub-Inspector of Guna district, sustaining his dismissal from service of 2 June 1953. The SP Guna had enquired into 18 counts of corruption and bribery and recommended dismissal, which the DIG Northern Range imposed after accepting findings on 7 charges; the IG had dismissed the departmental appeal. The Court held the DIG competent after the 1948 merger, found no violation of Article 311(1) and no fatal inquiry defect, and dismissed the application with costs.
