CW-1964-0002KeralaJudgment 9 March 1964

The State of Kerala and Anr. vs Kerala Police Police Constable

The Kerala High Court Division Bench allowed the State appeal against a Single Judge order that had quashed the dismissal of Police Constable. The Court held that the Circle Inspector who held the oral enquiry was competent under Rule 8 of the Kerala Police Departmental Enquiries, Punishment and Appeal Rules, 1958 read with the IG 1 August 1958 circular as a general authorisation. The Single Judge jurisdictional objection was found unsubstantial, the quashing order was discharged, and O.P. No. 2905 of 1961 was dismissed. The IG dismissal order, confirmed by Government after PSC consultation, therefore stands; the judgment does not state the underlying misconduct. Matters not addressed in the cited judgment text are not recorded here.
