Order issued
ConcludedThe Supreme Court of India upheld service punishment imposed on police personnel.
The Supreme Court on 1 April 1969 allowed the Union's appeal and dismissed Sub-Inspector's suit, restoring his 1949 dismissal from the Delhi Police. The Court found that the Daryaganj SI had been found guilty in a departmental enquiry of accepting a bribe connected with a criminal case. It held that the re-employed Deputy Superintendent remained a superior police officer competent to hold the enquiry, that city Superintendents of Police were competent dismissing authorities, and that oral evidence proved substantial compliance with Rule 16.38 of the Punjab Police Rules. The dismissal was restored with no order as to costs and no compensation. Matters not addressed in the cited judgment text are not recorded here.
