CW-1974-0003DelhiJudgment 19 April 1974

Delhi Police Constable vs The State

The Delhi High Court (P.S. Safeer, J.) on 19 April 1974 dismissed the appeal of Delhi Police constable of Police Station Kashmere Gate and upheld his conviction for demanding and accepting a Rs 60 bribe to release scooter-rickshaw DLR-5813. The court held the Anti-Corruption trap evidence proved demand and acceptance, with phenolphthalein-treated notes recovered after the appellant threw them across a wall on seeing the raiding Inspector. It held the presumption under Section 4(1) of the Prevention of Corruption Act, 1947 arose against him and the defence version had no veracity. The concurrent sentences of two years rigorous imprisonment and Rs 500 fine were maintained; the Supreme Court dismissed the further appeal on 15 February 1980 (AIR 1980 SC 873).
