ConcludedThe Delhi High Court recorded adverse findings against police personnel and ordered Rs 12,500.
The Delhi High Court held two Kotwali police officers personally liable for the false imprisonment of advocate a Delhi man, whom ASI Naut Ram Yadav arrested from court premises on 21 March 1957 relying on stale register entries that wrongly showed him as a proclaimed offender despite his discharge by a Magistrate in 1950. The Court found the ASI had arrested the plaintiff without verification despite his protests and held SHO liable for directing the drive and negligently failing to supervise the incorrect registers. It dismissed the Union of India's appeal, partly allowed the plaintiff's appeal, and decreed Rs 12,500 in damages jointly and severally against both officers and the Union of India, while recommending the Government consider action over the wrong register entries.
