CW-1983-0002West Delhi, DelhiJudgment 24 November 1983

State (Delhi Administration) vs Khem Chand

The judgment of the Delhi High Court records the following account. Complainant [name withheld] reported an assault and trespass at Patel Nagar police station, where a Section 452 IPC case was entrusted to Sub-Inspector Khem Chand; on 19 September 1975 Khem Chand told him his case was weak and demanded Rs. 100 and wine to champion his cause. The Anti-Corruption Branch laid a trap at the complainant's residence on 20 September 1975, where the accused accepted the bribe and the money was recovered from him. The Special Judge acquitted him on 30 October 1976 holding the demand unproved. The court held the Special Judge's approach basically erroneous, found the trap, recovery and phenolphthalein evidence proved acceptance, reversed the acquittal, convicted him under Section 161 IPC and Section 5(2)/5(1)(d) PC Act 1947, and, recording special reasons, sentenced him to one month RI plus Rs. 100 fine (concurrent) with a direction to surrender forthwith. Matters not addressed in the cited judgment text are not recorded here.
