CW-1984-0002DelhiJudgment 3 May 1984

State (Delhi Administration) vs Delhi Police Constable

The Delhi High Court Division Bench (R.N. Aggarwal and Malik Sharief-Ud-Din, JJ.) on 3 May 1984 allowed the State's acquittal appeal and restored the Metropolitan Magistrate's conviction of Delhi Police constable for drunken disorderly conduct and abuse outside House B-52, Kidwai Nagar, on the night of 20/21 February 1980. The court held the evidence of police witnesses who testified against a colleague, corroborated by the householder, was trustworthy, and that proof of intoxication was immaterial since the Delhi Police Act punishes indecent and disorderly behaviour regardless. It held no sanction under Section 197 CrPC was needed because abusing people and unruly conduct are not remotely connected with official duty. The acquittal dated 4 May 1983 was set aside and the fine of Rs 100 (in default 7 days simple imprisonment) restored. Matters not addressed in the cited judgment text are not recorded here.
