CW-1990-0002Nagpur, MaharashtraJudgment 18 January 1990

State of Maharashtra v. Chandraprakash Kewalchand Jain

The Supreme Court allowed the State appeal, set aside the Bombay High Court acquittal and restored the trial court's conviction of Sub-Inspector for raping newly-wed the complainant twice after isolating her from her husband on the night of 22 August 1981. The Court held a prosecutrix is a victim, not an accomplice, needing no corroboration, and refused to reduce the 5-year RI sentence, observing that punishment for rape by a person in uniform must be exemplary. The respondent was ordered to surrender forthwith and serve out the sentence. The trial acquittal under Section 342 was not disturbed. Matters not addressed in the cited judgment text are not recorded here.
