CW-1992-0005Central Delhi, DelhiJudgment 22 April 1992

Delhi Man and Others vs Commissioner of Police and Others

The Delhi High Court awarded Rs 1 lakh plus a job to the family of a Delhi man, beaten to death at PS Lahori Gate. Picked up hale and hearty by Constable on mere suspicion in the wee hours of 2 May 1991, he reached St. Stephen Hospital unconscious the same day with 16 ante-mortem injuries and died of cerebral damage on 10 May; the SDM inquest found severe beating in the police station and FIR 430/1991 was lodged against the constable. The Court held the family must be given adequate compensation for the custodial killing, recoverable from the erring officers after trial, while clarifying its observations would not prejudice the criminal proceedings. Matters not addressed in the cited judgment text are not recorded here.
