CW-1992-0008SPSR Nellore, Andhra PradeshJudgment 14 August 1992

Nellore Man vs Government of Andhra Pradesh and Ors.

The High Court found that police officers illegally abducted a Nellore man and two others from their homes on 30 January 1992, detained them in III-Town Police Station, Nellore, and subjected a Nellore man to custodial beatings to discover the whereabouts of an SI daughter who had entered into an interfaith marriage. The Sub-Inspector of III-Town Police Station defied a search warrant issued under Section 97 CrPC by an Advocate-Commissioner appointed by the Magistrate. Holding that the officers violated Articles 21 and 22 in an egregious display of lawlessness, the Court awarded Rs 10,000 compensation payable by the State with liberty to recover from the officers, and initiated criminal contempt proceedings against the Station House Officer. Matters not addressed in the cited judgment text are not recorded here.
