ConcludedThe Supreme Court of India recorded adverse findings against police personnel and ordered Rs 150,000.
A Jeraikela man, 22, was taken from home into custody at Jeraikela outpost on 01-12-1987 by ASI for a theft inquiry, handcuffed and detained; his body with multiple injuries was found on the railway track the next morning. The Supreme Court rejected the escape-and-train-accident story, confirming on reappraisal the District Judge's finding of death by multiple injuries inflicted in police custody. Holding it a custodial death violating Article 21 and rejecting sovereign immunity, the court awarded Rs 1.5 lakh compensation (term deposit for the mother) plus Rs 10,000 costs to the Supreme Court Legal Aid Committee. It directed the State to ascertain and fix individual responsibility and take appropriate action, in this landmark public-law compensation ruling.
