CW-1993-0007Kaithal, HaryanaJudgment 28 April 1993

Cheeka Police Sub-Inspector and others vs State of Haryana

A Cheeka man, a theft suspect re-arrested on 8 September 1986, was held in the Cheeka police lock-up where his father, uncle and the village Sarpanch saw all four accused policemen beat him over several days. On 15 September 1986 the police threw his body under a bus to fake a road accident; the post-mortem found 15 injuries with fractured ribs and injuries to the liver, spleen and testes. The Sessions Court had let the officers off on probation, but the Punjab and Haryana High Court convicted them under Section 304 Part I IPC with 10 years' rigorous imprisonment. The Supreme Court held the custodial beating proved beyond reasonable doubt, treated the officers' failure to explain the custody death as fatal, but altered the conviction to Section 304 Part II read with Section 34 IPC (knowledge, not intention) and reduced each sentence to 5 years' rigorous imprisonment. Matters not addressed in the cited judgment text are not recorded here.
