Salumber Police Constable vs State of Rajasthan and Others

The judgment of the Rajasthan High Court records the following account. On 19 November 1983 Constable of Police Station Sarada entered the quarters of ASI with a knife, tried to throttle and beat him, and threatened to kill him, leading to a criminal case under Sections 452, 323 and 427 IPC alongside a departmental enquiry. The disciplinary authority imposed removal/dismissal on 31 January 1985, affirmed in departmental appeal in October 1986, while the criminal trial convicted in 1987 but the appellate court acquitted in August 1988 for want of corroboration. The Single Judge dismissed the writ on 24 January 1994, holding simultaneous proceedings lawful and the dismissal on preponderance of probabilities unaffected by the benefit-of-doubt acquittal. The Division Bench agreed with that reasoning and dismissed the special appeal, so the dismissal stands.
