CW-1995-0001Neemuch, Madhya PradeshJudgment 9 May 1995

State of Madhya Pradesh vs Shyamsunder Trivedi and Ors.

The judgment of the Supreme Court of India records the following account. A Rampura man was brought to Rampura Police Station for interrogation on October 13, 1981, where he was subjected to brutal custodial torture and died of multiple traumatic injuries. The police attempted to screen the offence by creating false roznamcha entries and attempting to cremate the corpse as an unclaimed body until local bar members and villagers intervened. Setting aside the trial court acquittals and partial High Court acquittal, the Supreme Court convicted Sub-Inspector Shyamsunder Trivedi and three other police officers under Sections 304 Part II read with 34, 201, and 342 of the IPC. The Court held that when custodial death occurs, a presumption arises against the police custodians, sentencing Trivedi to two years RI plus Rs. 50,000 fine and the other three officers to one year RI plus Rs. 20,000 fine each, with all fines directed to be paid as compensation to the victim's heirs. Matters not addressed in the cited judgment text are not recorded here.
