CW-1995-0008Ernakulam, KeralaJudgment 31 July 1995

Kochi Resident vs State of Kerala and Others

The judgment of the Kerala High Court records the following account. On 16 October 1990, during a hartal-day riot in Mattancherry/Fort Cochin, a mob of about 100 armed persons looted the petitioner's vegetarian hotel although the police had been warned the previous day and had assured deployment. The petitioner's employee reported to Fort Cochin Police Station during the looting and the petitioner telephoned the station, the Assistant Commissioner and the control room, but the police did not react. The State contended it was practically impossible to protect every shop during a widespread riot. The court found the loss could have been avoided with adequate and timely steps, held the State liable in public law for violation of the petitioner's fundamental right, and awarded Rs.35,000 with 12% interest, leaving the State free to recover it from the negligent officers. Matters not addressed in the cited judgment text are not recorded here.
