Madhya Pradesh Police Sub-Inspector vs State of M.P. and Others

The Supreme Court on 6 November 1996 sustained the 1971 dismissal of Sub-Inspector, formerly in charge of Pakhanjur police station in what is now Chhattisgarh. The Court recorded that while SHO he received illegal gratification from gambling organiser N.K. Ghosh and failed to prevent his common gambling house, a charge proved in the departmental enquiry and confirmed on departmental appeal and by the M.P. High Court in 1978. It held the preliminary enquiry report need not have been supplied since it never formed the basis of dismissal, and that Evidence Act strictures do not govern departmental enquiries. The appeal, pursued by his legal representatives, was dismissed with no costs.
