CW-1997-0008Krishna, Andhra PradeshJudgment 6 August 1997

K. Yesupadam vs S.I. of Police, Penamaluru P.S., Vijayawada and Ors.

The High Court found that the Sub-Inspector of Penamaluru Police Station illegally detained a Vijayawada woman, a hospital aaya, for eight days from 23 March 1997 to 31 March 1997 without any General Diary entry, solely to pressure her absconding son to surrender. Accepting the inquiry report of the Principal District and Sessions Judge, Krishna, which corroborated the unlawful confinement through independent witness testimony, the Court held that the officer flagrantly violated her fundamental right to personal liberty under Article 21. The Court ordered the Sub-Inspector to personally pay Rs 10,000 compensation into a fixed deposit in the victim name for five years. Matters not addressed in the cited judgment text are not recorded here.
