CW-1997-0014Andhra PradeshJudgment 28 April 1997

The Government of Andhra Pradesh vs Andhra Pradesh Police Inspector of Police

The Supreme Court on 28 April 1997 confirmed the dismissal of Andhra Pradesh Inspector for demanding and accepting Rs. 3,000 to refrain from registering a complaint and launching a prosecution. The disciplinary tribunal found the charge proved and the Government dismissed him in July 1995, but the Administrative Tribunal asked the Government to reconsider a lighter penalty as dismissal shocked its conscience. The Court held that calibrating penalty to the gravity of proved misconduct is the disciplinary authority's domain, and a higher-ranking officer who sells non-prosecution damages the maintenance of law and order. It set aside the Tribunal's direction and confirmed the dismissal. Matters not addressed in the cited judgment text are not recorded here.
