CW-1998-0007Kanyakumari, Tamil NaduJudgment 28 January 1998

Director General of Police and Others vs Tamil Nadu Police Police Constable

The Supreme Court on 28 January 1998 sustained a major penalty against constable of a Kanyakumari crime detection party for extorting 31 grams of gold jewels from jeweller a Nagercoil man under coercion on 28 May 1983, with related charges of off-record detention and misappropriation of seized property. He was dismissed in April 1987, upheld on appeal and review, but the Tamil Nadu Administrative Tribunal set the dismissal aside on enquiry-report, competency and parity grounds. The Court rejected the first two grounds but applied parity with a co-delinquent Head Constable, substituting compulsory retirement for dismissal to meet the ends of justice. Matters not addressed in the cited judgment text are not recorded here.
