Conviction
ConcludedThe trial court convicted the accused police personnel, as recorded in the Bombay High Court judgment.
The judgment of the Bombay High Court records the following account. A Mumbai man, aged about 26, was tortured through the night of 27/28 June 1990 in the kachcha lock-up of Oshiwara Police Station by seven police officers, witnessed by co-detainees, and died of the injuries after admission to Bhagwati Hospital. The Additional Sessions Judge, Bombay acquitted the officers of culpable homicide under Section 304 IPC but convicted all seven under Section 330 IPC (3 years' RI for accused no. 1, 2 years' RI plus fine for the rest). The defence was total denial with a claim that kidnappers had assaulted Raju. The High Court dismissed the appeal, maintaining and confirming the convictions and sentences, remarking that the State should have appealed the Section 304 acquittal, and directed surrender within four weeks.
