CW-1999-0011Patna, BiharJudgment 30 September 1999

Rail Police Constable vs The State of Bihar and Others

The judgment of the Patna High Court records the following account. On 30 July 1996 a Rail Police constable shown as sick was caught by the Dy.S.P. (Rail) checking passengers' tickets in plain clothes on Patna Junction platform, in violation of standing orders, and fled across the tracks. An ex parte inquiry held him guilty of doubtful integrity and dereliction of duty, and the S.P. (Rail) dismissed him from service. The Patna High Court held the inquiry was lawful with full opportunity which the petitioner himself spurned, declined writ discretion given the grave and repeated charges, and dismissed the petition with the dismissal operating prospectively from 23 September 1997. Matters not addressed in the cited judgment text are not recorded here.
