CW-2000-0014Gwalior, Madhya PradeshJudgment 23 June 2000

Gwalior Police Constable vs State of M.P.

On the night of 23 July 1982, SAF Constable left his Quarter Guard duty post in Gwalior with his service.303 rifle and shot his neighbour, causing a firearm injury the Court noted was dangerous to life. The trial court convicted him under Section 307 IPC and imposed four years' rigorous imprisonment. The High Court held that the eyewitness account of the injured man's wife, corroborated by the appellant's absence from duty, the shortage of service cartridges and a recovered.303 cartridge, proved the charge despite the injured witness turning hostile and the missing ballistic report. The Court dismissed the appeal and affirmed the conviction and sentence, observing that the investigating agency had sided with the accused policeman throughout.
