ConcludedThe Andhra Pradesh High Court recorded adverse findings against police personnel and ordered Rs 100,000.
The judgment of the Andhra Pradesh High Court records the following account. The petitioner, a woman, was arrested and charge-sheeted for the murder of her husband under Section 302 IPC after he died during an epileptic seizure in November 1989. Despite forensic reports establishing that the deceased died from Mader vegetable poison administered by his own father to revive him, police pursued murder charges based on an unfounded theory that the wife gave him Musti Chekka poison. Following her acquittal by the Additional Sessions Judge, Khammam, she petitioned the High Court under Article 226 citing severe social ostracisation, wrongful lock-up, and giving birth to a daughter in prison. The High Court found the investigating and charge-sheeting officers guilty of gross negligence and lack of bona fides in falsely prosecuting her despite scientific evidence, ordering the State to pay Rs 1,00,000 as compensation for violation of her fundamental rights under Article 21. Matters not addressed in the cited judgment text are not recorded here.
