CW-2002-0007Anakapalli, Andhra PradeshJudgment 11 October 2002

K. Kotapadu Man vs Government of A.P. and Ors.

The Andhra Pradesh High Court held that a K. Kotapadu man, arrested on 24 August 1993 with a suspected stolen motorcycle, bore injuries sustained only after being brought to the police station, where he was chained by the leg to a window rod in the lockup. The Court found that in all probability he hanged himself on 25 August 1993 unable to bear physical torture by the police, rejecting the claim that he acted from despondency and calling it strange that officers in the front room noticed nothing. Holding that his fundamental right to life under Article 21 had been violated, the Court awarded his 25-year-old widow Rs 1,00,000 as compensation, directing the State to hold it in a five-year fixed deposit with quarterly interest payable to her. The judgment identifies the erring officer only as the second respondent. Matters not addressed in the cited judgment text are not recorded here.
