Mysuru Woman & Anr. vs The State of Karnataka & Ors.

The judgment of the Karnataka High Court records the following account. a woman, a 48-year-old maidservant, was taken to Devaraja Police Station on 4 May 1993 for interrogation in her employer's theft complaint and kept upstairs without a woman guard; she alleged her fingernails were pressed and she was threatened with stripping and gang rape. Fearing torture she jumped from the second floor and suffered grievous fractures leaving permanent disability in her right hand and leg, while the theft case ended in a C-report. The department exonerated three officials and let WHC [name withheld] off with a censure on appeal. The High Court found police excesses violating Article 21, awarded Rs 2,00,000 compensation (Rs 1,50,000 in fixed deposit, Rs 50,000 cash, 12% interest on default) plus Rs 5,000 costs to Samata Vedike, and directed the DGP to re-examine the departmental proceedings and take remedial action. Matters not addressed in the cited judgment text are not recorded here.
