ConcludedThe Bombay High Court recorded adverse findings against police personnel and ordered Rs 25,000.
The Bombay High Court (Nagpur Bench) held that Police Station Officer of Veltur falsely arrayed housewife Sharda Bhongade as an accused in a 1995 morcha case without any investigation, showing blatant disregard for the rule of law. The court found she suffered mental and physical agony, monetary loss and loss of self-esteem until her discharge by the Judicial Magistrate First Class, Kuhi, in clear violation of her Article 21 rights. It directed the State Government to pay her Rs. 25,000 compensation within four weeks of communication of the order, with liberty to recover half the amount from the delinquent officer. The petition began as a letter dated 6 February 2002 converted into a criminal writ petition. Matters not addressed in the cited judgment text are not recorded here.
