ConcludedThe Andhra Pradesh High Court recorded adverse findings against police personnel and ordered Rs 50,000.
The judgment of the Andhra Pradesh High Court records the following account. A Makthal man of Karni village was apprehended on 9 May 2001 by Sub-Inspector and staff of Makthal Police Station as a suspect in his first wife death and held in unrecorded, illegal lock-up for five days without being produced before a magistrate. On 14 May 2001, while under severe mental strain and fleeing police custody, he climbed a 60-foot electric transmission tower and jumped to his death. On a writ petition by his widow, the High Court held that the deceased was subjected to unconstitutional, degrading detention violating fundamental rights and D.K. Basu guidelines. The Court ordered the State to pay Rs 50,000 in compensation to the widow (recoverable from the Sub-Inspector), directed the Superintendent of Police to register a murder case under Section 302 IPC and initiate disciplinary proceedings, and initiated suo motu contempt proceedings against the officer.
