CW-2003-0004Koppal, KarnatakaJudgment 20 March 2003

Koppal Man & Ors. vs State of Karnataka & Ors.

The judgment of the Karnataka High Court records the following account. Three men arrested on 19 November 1998 (falsely shown as arrested on 20 November to feign production within 24 hours) were handcuffed, chained and paraded in briefs only through the streets of Koppal from the police station to the Magistrate's residence on the evening of 20 November 1998. A departmental enquiry whitewashed the incident, so the High Court ordered a CBI enquiry, which proved the arrest-date falsification and the parading. The High Court held respondent No. 6, Inspector, had interfered with the petitioners' liberty and damaged their reputation in violation of Articles 21 and 22(2) and the Karnataka Police Manual, and directed him personally to pay Rs 15,000 to each petitioner (Rs 45,000 total) within three months. Matters not addressed in the cited judgment text are not recorded here.
