ConcludedThe Madras High Court recorded adverse findings against police personnel and ordered Rs 900,000.
The judgment of the Madras High Court records the following account. Justice D. Murugesan held that a Karur man died in police custody due to torture by SI of Karur police station and awarded Rs 9 lakh total just compensation (Rs 8 lakh balance after the Rs 1 lakh ex-gratia already paid), apportioned equally among the widow, two minor sons and mother, payable within one month. A Karur man was taken into custody at 5 a.m. on 23 March 1995 and beaten to death in the police van; the Sub-Collector Karur enquiry under PSO 145 found death solely due to torture by the SI and the post-mortem showed neurogenic shock from chest injuries. The State did not deny torture in its counter. The court held [name withheld] to have tortured and beaten the deceased to death and ordered Rs 9 lakh total compensation with departmental punishment; the related criminal case ended in acquittal with the State appeal pending, so no criminal conviction subsists on this record. The Court computed quantum on the motor-accident multiplier method (Rs 6,000/month income, multiplier 18), noting the SI's criminal prosecution had ended in acquittal with a State appeal pending.
