Conviction
ConcludedThe trial court convicted the accused police personnel, as recorded in the Supreme Court of India judgment.
The Supreme Court maintained the murder conviction of Bihar Police constable for shooting dead three colleagues at the Narhi police camp in Bhojpur on 9 April 1996, after seizing a Hawaldar's sten-gun. The Court found that the killing of Hawaldar a Chakardah village man, who had reprimanded him, was driven by anger and panic, and the killing of the other two policemen was done in a state of frenzy without premeditation. It held the indiscriminate killing of fellow policemen by a disciplined-force member aggravating but offset by mitigating circumstances, and therefore set aside the death sentence while sentencing him to life imprisonment with a fine of Rs. 1,000. The Court also set aside his conviction under Section 27 of the Arms Act for want of proof that the sten-gun was a prohibited arm.
