CW-2004-0005Kiphire, NagalandJudgment 7 December 2004

Kiphire Man vs State of Nagaland and Ors.

The Gauhati High Court held that a Kiphire man was locked in Kiphire police station lockup on the night of 24 July 2001 without any legal authority and found dead inside the lockup the next morning, accepting the ADC(J) Tuensang enquiry findings. It found his body was disposed of without following mandatory legal procedure including post-mortem. Though the enquiry could not pin direct responsibility on any individual, the Court awarded Rs 3,00,000 compensation plus Rs 15,000 costs, with half the compensation secured for the children. The finding rests on illegal detention combined with death in custody rather than proven torture. Matters not addressed in the cited judgment text are not recorded here.
