CW-2004-0006North 24 Parganas, West BengalJudgment 18 August 2004

Dum Dum Man vs State of West Bengal And Ors.

The judgment of the Calcutta High Court records the following account. At about 1 a.m. on the night of 4-5 July 2002, a 15-20 member police party dragged Central Excise Inspector from his Dum Dum home and returned him only at 11 a.m.; he later died by suicide, which his widow linked to the arrest and interrogation. The Division Bench held the high-handedness clearly established, a Dum Dum man under arrest throughout, and the D.K. Basu guidelines, having the force of law, admittedly not followed at all, invading the family's Article 21 privacy. Though no compensation was prayed for, the Court moulded relief and directed Rs.1 lakh within a fortnight as a deterrent, preserving the widow's right to sue the wrongdoers. Individual officers were not identified in the order. Matters not addressed in the cited judgment text are not recorded here.
