CW-2005-0020Chatra, JharkhandJudgment 23 December 2005

Pratappur Police Constable vs State of Jharkhand and Others

The Jharkhand High Court (M.Y. Eqbal J.) on 23 December 2005 dismissed the writ petition of JAP-7 constable against his dismissal for habitual unauthorised absence. The court recorded that he absconded from 18 April to 29 July 2002 (102 days), covering it with a story of kidnapping by Naxalites that neither his superior officers nor the Chatra police had reported, supported by a private practitioner's certificate of mental-illness treatment, and that he had three earlier major punishments for absconding for up to 186 days before absconding again in December 2002. The court held the kidnapping story was hatched to cover wilful absence and that he was not fit to be retained in police service. It declared the dismissal order perfectly legal and valid and dismissed the writ petition, so the dismissal stands. Matters not addressed in the cited judgment text are not recorded here.
