Conviction
ConcludedThe trial court convicted the accused police personnel, as recorded in the Madras High Court judgment.
A Division Bench of the Madras High Court confirmed the murder convictions and life sentences (with Rs 2,000 fine) of Sub-Inspector Anthonysamy and Constable Veerasamy of Kammapuram Police Station for beating burglary suspect [name withheld] to death in the station on 21-22 March 1993, dumping his body on a road and passing the death off as an escape from custody. Relying on the evidence of the victim wife and a co-detenu, the Court held it proved beyond doubt that a Kammapuram man died in the station after a brutal assault by the two officers, and confirmed the allied convictions for wrongful confinement, extortion of confession by hurt, destruction of evidence and related offences while setting aside the conspiracy charge. A-3 Constable Ramasamy was convicted only under Section 323 IPC and admonished under Section 3 of the Probation of Offenders Act with no sentence, being acquitted of the graver charges with fines refunded; the life sentences in this judgment concern his co-accused. Constable Ramasamy was acquitted of the grave charges, convicted only under Section 323 IPC and admonished under the Probation of Offenders Act; Inspector accepted his fine-only conviction and the State appeal against the doctor acquittal was dismissed.
