ConcludedThe Jharkhand High Court upheld service punishment imposed on police personnel.
The Jharkhand High Court Division Bench (S.J. Mukhopadhaya and Permod Kohli JJ.) on 19 May 2006 dismissed the Letters Patent Appeal of constable of Sadar Court, Dhanbad, against his dismissal for habitual absconding from duty since November 2000. The court recorded that an ex parte departmental enquiry had held him guilty after he failed to participate, and that the Superintendent of Police, Dhanbad had dismissed him on 27 July 2003 considering his reply, the enquiry report and about eleven prior instances of absconding. The court held the dismissal was not contrary to Rule 826 of the Bihar Police Manual Vol. 1 nor disproportionate, and that no subsistence-allowance illegality occurred since he never stayed at headquarters during suspension. It found no ground to interfere with the dismissal or the Single Judge's order dismissing his writ petition, and dismissed the appeal.
