ConcludedThe Gauhati High Court recorded adverse findings against police personnel and ordered Rs 500,000.
The judgment of the Gauhati High Court records the following account. On 13 June 1983 a Lamlai police party went to arrest a Lamlai man, 25, in a kidnapping case; when he fled, constables chased and fired, one bullet hit him and he died on the way to hospital. The criminal case under section 304-A IPC ended with the Officer-in-charge discharged and the constable acquitted, but the deceased's mother won a Rs.5 lakh money-suit decree against the five officers. On 29 November 2006 the High Court held that where a government servant causes death in violation of law while on duty, the State must compensate first and may recover from the erring servants. It maintained the Rs.5 lakh award (no interest) but modified the decree so the State of Manipur pays within three months, recoverable from the officers. Matters not addressed in the cited judgment text are not recorded here.
