CW-2007-0010Mandi, Himachal PradeshJudgment 30 August 2007

Mandi Police personnel v. State of H.P. & Anr.

The Himachal Pradesh High Court upheld the conviction and sentence of the in-charge of PS Sadar Mandi, who summoned a village woman to the station on 30 August 1994, bolted the upper-storey room and raped her after threatening to implicate her family in a poisoning case he was investigating. The Court refused leniency since he took undue advantage of his position as station in-charge, sustaining 10 years RI with the Rs 20,000 fine payable to the prosecutrix. The appeal was dismissed. The prosecutrix had secured justice only through a Section 156(3) application after even the SP failed to help. Matters not addressed in the cited judgment text are not recorded here.
