CW-2007-0011Barwani, Madhya PradeshJudgment 25 September 2007

Bajatta Khurd, Badwani Woman vs State of M.P. and Anr.

The judgment of the Madhya Pradesh High Court records the following account. On 25.7.2007 Badwani police arrested scores of Sardar Sarovar oustees agitating at the Jamin Hak Satyagraha and detained them in Badwani and Indore jails till 30.7.2007 purportedly under Section 151 CrPC. The State contended the agitators had blocked the highway, manhandled officials and created a law-and-order problem. The Court watched the CDs of the arrest and held the State's version totally false, finding the agitators were peacefully shouting slogans in exercise of Articles 19(1)(a)/(b) and the s.151 conditions (known design to commit a cognizable offence) were not met. It held the arrests and detention unauthorised violations of Articles 19 and 21 and awarded Rs 10,000 compensation to the petitioner and each agitator detained in jail, with liberty to recover from responsible officers after proper inquiry. Matters not addressed in the cited judgment text are not recorded here.
