Chandigarh Man v. State (Union Territory of Chandigarh) and Others

A Division Bench partly allowed the writ of Phoolwati, mother of 21-year-old a Chandigarh man, who died in custody at PS Manimajra on 11 July 2007 after being taken to SI 's first-floor room and found fallen from a height. The Court accepted the SDM's magisterial enquiry finding the SI guilty of negligence and gross dereliction, noted D.K. Basu violations including no arrest memo or intimation, and awarded Rs 9.95 lakh compensation computed on multiplier principles, payable by the UT Administration within three months. It declined the CBI-transfer prayer as the Crime Branch probe, magisterial enquiry, post-mortem and CCTV record left little scope for further investigation. Matters not addressed in the cited judgment text are not recorded here.
